Terms of Service

Effective June 2026

1. Acceptance

These Terms of Service ("Terms") govern your use of tact-energy.com and the services offered by Tact Energy LLC ("Tact Energy," "we," "us"). By using this site or submitting a form, you agree to these Terms. The site is intended for customers in deregulated areas of Texas (the ERCOT market).

2. Who we are

Tact Energy LLC is a Registered Texas Electricity Broker (PUCT Control No. 49779), authorized under Texas Utilities Code (PURA) §39.3555. We are a broker, not a retail electric provider (REP). We do not sell or take title to electricity, we do not provide electric service, and we do not send your electric bill.

3. Our services

We provide independent brokerage services: we compare offers from retail electric providers and help you select a provider that fits your needs. The REP you choose — not Tact Energy — provides your electricity service, enrolls you, and bills you under the REP's own contract.

4. No fees and no payments to us

You pay no separate fee to Tact Energy for our brokerage services, and we never collect, handle, or hold customer payments or funds. All charges for your electricity service are billed and collected by your chosen REP.

5. How we are compensated

Tact Energy is compensated by the retail electric providers and suppliers we work with. Our compensation does not change your right to select any provider you wish, and it does not add any cost to you.

6. Your right to choose

You choose your own REP and may accept or decline any offer we present. You may also shop independently, including through the Public Utility Commission of Texas's official shopping website, Power to Choose (powertochoose.org). Using Tact Energy is never required.

7. Authorization and switching

We will not switch, or cause to be switched, your retail electric provider, and we will not cause any charge to appear on your electric bill, without first obtaining your authorization. When account enrollment is offered, you will be asked to provide a written authorization describing what you authorize, how long it lasts, and how to terminate it; we will provide evidence of our authority to act as your agent to the Commission or upon request.

8. No guarantee of savings

Any savings figures, rates, or estimates shown are illustrative, are based on the information you provide, and are not a promise of a particular outcome. Actual pricing and terms are set by the REP's final contract.

9. Accuracy of information

You are responsible for providing accurate account and usage information. Offers and analyses are subject to verification and the REP's final contract.

10. Relationship with providers

We may work with multiple retail electric providers. The REP's contract, Electricity Facts Label, Terms of Service, and Your Rights as a Customer documents govern your electricity service. Those documents are provided by the REP, not by Tact Energy.

11. Privacy and data sharing

Our Privacy Policy is incorporated into these Terms. We share your information with a retail electric provider only with your authorization, and we do not sell your personal data.

12. Complaints and customer protections

You may contact us at info@tact-energy.com or through our contact form for questions, complaints, or to withdraw an authorization. For residential and small commercial customers, nothing in these Terms waives your right to file a complaint with the Public Utility Commission of Texas (Customer Protection Division, P.O. Box 13326, Austin, TX 78711-3326; toll-free 1-888-782-8477; customer@puc.texas.gov), and we do not require mandatory binding arbitration of any dispute with these customers.

13. Marketing communications

If you opt in, you may receive marketing communications by phone, text (SMS), or email. Marketing consent is optional and not a condition of using our services. For SMS, message frequency varies and message and data rates may apply; reply STOP to opt out and HELP for help. You may unsubscribe from emails at any time.

14. Disclaimers and limitation of liability

Tact Energy is not responsible for the electricity service, billing, outages, or reliability provided by any retail electric provider, and we do not guarantee any particular result. To the fullest extent permitted by law, our liability arising from your use of the site or our brokerage services is limited.

15. Governing law

These Terms are governed by the laws of the State of Texas, without limiting the customer-protection and complaint rights described above.

16. Changes and contact
